GoFetch Auto LLC(“GoFetch Auto,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy describes how we collect, use, disclose, and protect information when you visit our website, use our client portal, or engage our car buying advocacy services (collectively, the “Services”). By using the Services, you agree to this Policy.

Quick summary: We collect only what we need to help you buy a car. We never sell your personal information. We never reveal your identity to dealerships during negotiations. You can request access, correction, or deletion at any time by emailing inquiry@gofetchauto.com.

1. Information We Collect

Information You Provide to Us:

  • Identifiers: name, email address, phone number, mailing address
  • Vehicle preferences, budget, trade-in details, and purchase criteria
  • Financial information relevant to your purchase, such as financing preferences, down payment amount, and (only if you elect to share it) pre-qualification information. We do not collect full Social Security numbers or bank account credentials
  • Driver’s license or ID information if required for delivery
  • Documents you upload to your client portal
  • Electronic signature data for the Buyer Representation Agreement
  • Communications with our team (email, SMS, phone, portal messages)

Information Collected Automatically:

  • IP address, browser type, device identifiers, and operating system
  • Pages visited, referring URLs, and time spent on the site
  • Cookies, pixels, and similar tracking technologies (see Section 7)

Information From Third Parties: We may receive limited information from payment processors (Stripe), analytics providers, and dealerships during the course of your engagement.

2. How We Use Your Information

We use your information to:

  • Provide, manage, and improve our advocacy services;
  • Negotiate with dealerships on your behalf using anonymized criteria;
  • Communicate with you about your deal (email, SMS, phone, portal) including transactional alerts;
  • Process payments and issue refunds;
  • Verify your identity and prevent fraud;
  • Enforce our Terms of Service and protect our rights;
  • Send marketing communications only with your consent, which you can withdraw at any time; and
  • Comply with legal, tax, accounting, and regulatory obligations (including Florida recordkeeping requirements).

3. Legal Bases for Processing

We process your personal information based on one or more of the following legal bases: (a) performance of a contract with you (delivering the Services); (b) your consent (e.g., marketing emails, SMS messages); (c) our legitimate interests in operating and securing our business; and (d) compliance with legal obligations.

4. How We Share Information

We share your information only in these circumstances:

  • Dealerships: We share only anonymized purchase criteria during negotiations. Your name and personal contact details are not revealed to a dealership until you accept a deal and it is time to finalize the purchase.
  • Service Providers (Subprocessors): Trusted vendors who help us run the business under confidentiality obligations, including Stripe, Inc. (payments), Twilio / SMS carriers (text messaging), email delivery providers, Vercel (website hosting), and Google Analytics (with IP anonymization enabled).
  • Legal & Safety: When required by law, subpoena, court order, or to protect the rights, property, or safety of GoFetch Auto, our clients, or the public.
  • Business Transfers: In connection with a merger, acquisition, financing, or sale of assets, subject to the acquirer honoring this Policy.
  • With Your Direction: When you instruct us to share information (e.g., with a specific lender or co-buyer).

We do not sell or rent your personal information, and we do not share it for cross-context behavioral advertising.

5. Dual Anonymity During Negotiation

GoFetch Auto employs a dual-anonymity workflow during negotiations. Dealers do not learn your identity while we shop your deal, and you do not see the specific dealer identity until you accept a finalized offer. This protects you from unwanted outreach and supports a fair, merit-based negotiation.

6. SMS / Text Messaging (TCPA)

If you provide your mobile number and opt in, you expressly consent to receive transactional and service-related text messages from GoFetch Auto, including from automated systems, about your engagement, deal status, appointments, and account. Consent is not a condition of purchase.

Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out, or HELP for help. Mobile information (phone numbers and SMS consent data) is not shared with third parties or affiliates for marketing or promotional purposes. Carriers are not liable for delayed or undelivered messages.

7. Cookies & Tracking Technologies

We use the following categories of cookies and similar tools:

  • Strictly Necessary: Required for login, security, and core site functionality.
  • Analytics: Google Analytics, configured with IP anonymization, to understand aggregate usage patterns.
  • Preferences: Remember your settings and improve your experience.

You can control cookies through your browser settings and, where applicable, through our cookie banner. We honor Global Privacy Control (GPC) signals as a request to opt out of sale or sharing of personal information. We do not use third-party advertising cookies.

8. Data Security

We implement administrative, technical, and physical safeguards designed to protect your information, including TLS encryption in transit, encrypted storage at rest, role-based access controls, least-privilege principles, and periodic security reviews. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security. In the event of a data breach affecting your personal information, we will notify affected Florida residents in accordance with the Florida Information Protection Act (FIPA), Fla. Stat. § 501.171.

9. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, enforce our agreements, resolve disputes, and comply with legal obligations (including tax and accounting laws, which generally require four to seven years of retention). In general, we delete or anonymize client personal information three (3) years after your last transaction or interaction, except where longer retention is required by law or to preserve records subject to a legal hold. You may request earlier deletion as described in Section 10.

10. Your Privacy Rights

Subject to applicable law, you have the right to:

  • Access and receive a copy of the personal information we hold about you;
  • Correct inaccurate or incomplete information;
  • Delete your personal information;
  • Restrict or object to certain processing;
  • Port your data in a machine-readable format;
  • Withdraw consent where processing is based on consent; and
  • Appeal our decision on a privacy request if we decline (we will respond to appeals within a reasonable time).

To exercise these rights, email inquiry@gofetchauto.com with the subject line “Privacy Request.” We will verify your identity before fulfilling the request and will respond within the time required by applicable law (generally 30–45 days). We will not discriminate against you for exercising your rights.

11. Florida Residents

GoFetch Auto is a Florida LLC and complies with Florida consumer-protection and privacy laws, including the Florida Deceptive and Unfair Trade Practices Act (FDUTPA) and the Florida Information Protection Act (FIPA). If the Florida Digital Bill of Rights (FDBR) applies to us, Florida residents may exercise the rights described in Section 10 and may appeal denied requests. Contact us using the information in Section 15.

12. California Residents (CCPA / CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the CPRA, provides the rights described in Section 10 plus the following disclosures.

Categories of personal information collected in the past 12 months:

  • Identifiers (name, email, phone, IP address)
  • Customer records (financial preferences related to your vehicle purchase)
  • Commercial information (deal history, fee payments)
  • Internet or network activity (site usage data)
  • Geolocation (approximate, from IP address)
  • Inferences (vehicle preferences derived from your criteria)

Sources: you, automated technologies on our site, and service providers. Business purposes: providing the Services, security, fraud prevention, analytics, and legal compliance.

We do not “sell” or “share” personal information as those terms are defined under the CCPA/CPRA, and we do not knowingly sell or share the personal information of minors under 16.

California residents may designate an authorized agent to submit requests on their behalf. You may contact us with a “Do Not Sell or Share My Personal Information” request, although we do not engage in such activities.

13. European Residents (GDPR / UK GDPR)

If you are located in the European Economic Area, United Kingdom, or Switzerland, GoFetch Auto acts as a data controller for personal information you provide. The legal bases for processing are described in Section 3. You have the rights described in Section 10, plus the right to lodge a complaint with your local supervisory authority.

Because our Services are operated from the United States, your personal information will be transferred to and processed in the U.S. Where required, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses for international data transfers. Note: Our services are generally intended for U.S. residents purchasing vehicles in the United States.

14. Children’s Privacy

The Services are not directed to, and we do not knowingly collect personal information from, individuals under 18 years of age. If you believe a minor has provided us personal information, please contact us and we will promptly delete it.

15. Changes to This Policy

We may update this Policy periodically. We will post the updated version on this page and revise the “Last updated” date. If the changes are material, we will provide additional notice by email or a prominent site banner. Your continued use of the Services after the effective date constitutes acceptance.
